Agree or Disagree: Courtroom Perspectives with Trial Attorney Steve Duckett
Northern Virginia Trial Insights
In our Agree or Disagree series, Battlefield Law Group partner Steven L. Duckett, Jr. weighs in on common statements about trial work. With more than 25 years of courtroom experience, Steve combines wit with hard-earned insight, giving clients and viewers a candid look at what really matters when defending a case in Northern Virginia.
Some of his takes may not be what you expect. Watch the Video
Statement 1: A lawyer doesn’t need to prep witnesses as much as they prep themselves.
Steve: Disagree. He believes the most prepared person in the room should always be the lawyer—but the client comes second. Without that preparation, credibility and confidence suffer.
Statement 2: The color of your suit doesn’t matter.
Steve: Mostly disagree. He jokes that he’s no fashion expert, but says one thing for sure: leave the banana-yellow suit at home. Presentation may not win the case, but it sets the tone.
Statement 3: The biggest win is getting the jury to like you.
Steve: Disagree. The real win is simple: Not Guilty. Likeability helps, but trust in the defense and the evidence matters more.
Statement 4: Law school teaches you how to win in court.
Steve: Disagree. Law school teaches statutes and theory. The courtroom teaches survival, strategy, and how to actually win. Nothing substitutes for real trial experience.
Statement 5: If you’re not nervous before opening statements, you’re not ready.
Steve: Disagree. Nervous energy is contagious, and juries pick up on it quickly. A lawyer’s job is to project calm, control, and confidence at every stage.
Statement 6: Most lawyers know how to cross-examine.
Steve: Agree, with a twist. Many lawyers don’t. Cross is an art form, and one of the hardest skills to master. Too many attorneys treat it like throwing paint at the wall, instead of building a careful, strategic line of questioning.
