Malicious Wounding: What Prosecutors Must Prove and How We Fight Back

Malicious Wounding is a serious felony in Virginia that occurs when someone unlawfully causes another person significant physical injury, such as broken bones, deep lacerations, or permanent disfigurement, with the intent to maim, disfigure, disable, or kill. It often arises from heated disputes, fights, or altercations where a weapon or excessive force was used. Intent is key, and it is something prosecutors must prove beyond a reasonable doubt.

There are multiple levels of this offense:

  • Malicious Wounding (Va. Code § 18.2-51): Requires intent to injure seriously.

  • Unlawful Wounding: Same act without proven intent.

  • Aggravated Malicious Wounding (Va. Code § 18.2-51.2): Victim suffers permanent, significant physical impairment.

  • Unlawful Wounding (Class 6 felony): 1 to 5 years in prison or up to 12 months in jail and/or a $2,500 fine
