Defective Equipment – VA Code § 46.2-1000
Virginia law requires every vehicle on the road to be in a safe, working condition. Under VA Code § 46.2-1000, you can be cited for operating a vehicle with defective or unsafe equipment, including:
Worn or damaged brakes
Broken or missing headlights or taillights
Cracked windshields that obstruct vision
Bald or unsafe tires
Faulty exhaust systems or turn signals
Suspension or steering problems
While this is often treated as a non-criminal traffic infraction, it’s also one of the most common justifications officers use to initiate a stop — especially when they suspect impaired driving or other violations.
If your stop for defective equipment led to DUI charges, search of your vehicle, or additional citations, the original basis for the stop becomes a key issue in your defense. If the alleged defect was minor, unobservable, or didn’t impact safety, the stop may not hold up under scrutiny.
