Building a Strong DUI Defense Starts With the Details
A DUI charge can feel overwhelming, especially when the police report seems detailed and the arrest has already happened. But a DUI case is not decided by the report alone.
At Battlefield Law Group, we are heavily invested in aggressive, innovative DUI defense strategies. Our attorneys do not simply accept the Commonwealth’s version of events. We examine the evidence, challenge the procedures, and look for the details that can change how a case is understood.
That commitment includes continued advanced training. Attorney Rob Yurkowski recently completed a three-day National College for DUI Defense course in Charleston focused on Standardized Field Sobriety Testing. The program trained defense attorneys on the same SFST procedures used by law enforcement during DUI investigations, including roadside testing, officer observations, note-taking, testimony, and practical alcohol workshops.
That training becomes especially important when body camera footage is available.
What Can Body Cam Footage Show in a DUI Case?
A police report is an officer's written account of what happened. Body camera footage can provide another perspective on the same encounter.
The video may show how a driver spoke, moved, followed instructions, interacted with the officer, and performed during roadside testing. It can also provide context for observations described in the report and show how the investigation unfolded in real time.
That does not mean body camera footage will automatically help the defense. Sometimes it supports the officer's account. Other times, it may raise questions about whether the written description fully matches what can actually be seen and heard.
That is why our attorneys want to review the evidence rather than simply accept the report at face value.
The DUI Report and the Video Do Not Always Tell the Story the Same Way
Words such as "unsteady," "slurred," "confused," or "unable to follow instructions" can carry significant weight in a DUI report. Video gives a defense attorney an opportunity to evaluate those observations independently.
Does the person actually appear unsteady? Are they answering questions appropriately? Were instructions clear? Was the roadside environment dark, uneven, distracting, or otherwise relevant to the person's performance? Does the footage show what the officer described?
Small details can become important when the Commonwealth is relying on an officer's observations as evidence of impairment.
Body Cam Footage Can Matter During Field Sobriety Testing
Standardized Field Sobriety Tests are designed to be administered according to specific procedures. Video may allow an attorney to review the instructions given, the conditions under which the tests were performed, and the driver's actual performance.
Rob's recent NCDD training focused on those same procedures, including the three phases of DWI detection, field sobriety testing, officer documentation, testimony, and proficiency testing. That type of hands-on training helps our attorneys evaluate whether the tests were administered properly and whether the conclusions drawn from them are supported by the footage.
Lynchburg DUI Cases and Body-Worn Camera Evidence
The Lynchburg Police Department has used body-worn cameras since 2017 and maintains a system for providing body-camera footage to defense attorneys through discovery. The department also uses in-car video and other digital evidence as part of criminal investigations.
For someone facing a DUI charge in Lynchburg, that means there may be video evidence showing portions of the stop and investigation that should be reviewed as part of the defense.
Other agencies throughout Bedford, Campbell, Amherst, Appomattox, Nelson, and surrounding Central Virginia jurisdictions may have their own body-camera systems, procedures, and available evidence.
A DUI Charge Is Not the Same as a Conviction
Virginia law prohibits driving or operating a vehicle while intoxicated under several circumstances, including having a blood alcohol concentration of .08 or higher or being impaired by alcohol or drugs. But an arrest does not eliminate the Commonwealth's responsibility to prove the case.
A DUI defense can involve much more than a breath or blood result. The traffic stop, officer observations, field sobriety testing, body camera footage, chemical testing, statements, and other evidence may all need to be examined together.
At Battlefield Law Group, our attorneys hold the Commonwealth to its burden and look closely at whether the evidence supports the charge and whether proper procedures were followed.
