What Counts as a Probation Violation in Virginia
Virginia law (Va. Code § 19.2-306 and § 19.2-306.1) separates violations into two main types:
Technical violations – missed check-ins, positive drug screens, failure to update your address or employment, and similar lapses.
New-law violations – being convicted of a new criminal offense while on probation.
Key Sentencing Rules
First technical violation: No active jail time permitted.
Second technical: Presumption against jail; if imposed, capped at 14 days.
Third or subsequent technical: Court may impose any previously suspended time.
New-law violations: Court can revoke and impose any or all of the suspended sentence.
